No Unauthorized System Access or Network Abuse

No Adult Content

Hosting, sharing, or distributing pornographic, sexually explicit, or otherwise adult material is prohibited on our platform.

No Storage of Backups

Our hosting services are not to be used solely for the purpose of storing backups or archive files unrelated to the primary function of the hosted content.

2. Zero Tolerance Spam Policy

No Unsolicited Messages

We have a zero-tolerance policy towards spam. Sending unsolicited bulk messages, advertisements, or marketing emails without proper consent is prohibited.

No Unauthorized System Access or Network Abuse

Using our platform to send spam or to facilitate spam-related activities, including email harvesting, is forbidden.

No Adult Content in Spam

Spam messages containing sexually explicit or adult material will result in immediate account suspension.

No Storage of Backups for Spam Purposes

Storing files solely for the purpose of distributing spam or harmful materials is not allowed.

3. Defamation and Objectionable Content

You may not use our services to publish or share defamatory, abusive, harassing, hateful, or otherwise objectionable content that may harm the reputation or rights of others.

4. Enforcement

Resellers

Resellers are responsible for ensuring their customers comply with this AUP. Failure to enforce these rules may result in suspension or termination of the reseller’s account.

Direct Customers

We reserve the right to monitor usage and take necessary actions, including warnings, suspensions, or account termination, against direct customers who violate this AUP.

Continued violation of this policy may result in permanent account closure, reporting to authorities, or legal action as necessary.

Infringement Policy

We respect the intellectual property rights of others and expect our users to do the same. Any user who is found to have infringed on copyrights, trademarks, or other protected materials may have their account suspended or terminated. This policy outlines our procedure for handling infringement claims in compliance with applicable laws, including the Digital Millennium Copyright Act (DMCA).

Counter Notice Procedure for Customers

If you believe your content was removed or disabled by mistake due to an infringement notice, you may submit a counter notice to request restoration of the material. Your counter notice must include:

  • Your full name, address, telephone number, and email address.
  • Identification of the content that was removed or disabled and its location before removal.
  • A statement under penalty of perjury that you have a good faith belief the material was removed or disabled due to mistake or misidentification.
  • Your signature (physical or electronic).

Upon receiving a valid counter notice, we may restore the removed material unless the original complainant files a legal action seeking to prevent its restoration.

Prohibited Uses

Unauthorized access to systems, hacking, network interference, or attempts to breach security measures are strictly prohibited.

No Adult Content

Hosting, sharing, or distributing pornographic, sexually explicit, or otherwise adult-oriented material is not permitted on our platform.

No Storage of Backups

Our services must not be used solely as an off-site backup or archive system unless explicitly allowed by your service agreement.

Backup Policy

Our backup policy is designed to ensure that customer data is protected against loss or damage. While we maintain regular system backups for disaster recovery purposes, customers are ultimately responsible for maintaining their own copies of important data. Backups we create are intended for service continuity and not as a guaranteed long-term archive.

We recommend that all customers maintain their own regular, independent backups in addition to any provided by us. This ensures data is secure even in cases of accidental deletion, corruption, or other unforeseen events.

Prohibited Uses

Backups must not contain content or data that violates applicable laws, infringes on intellectual property rights, or causes harm to individuals or organizations.

No Unauthorized System Access or Network Abuse

Backups must not include tools, scripts, or software intended for hacking, network interference, or security breaches.

No Adult Content

Hosting or storing pornographic, sexually explicit, or other adult-oriented material in backups is strictly prohibited.

No Storage of Backups

Our services must not be used solely for off-site storage or archival of large backups unless expressly permitted by your service agreement.

Duplicate Backup Storage Prohibited

Uploading the same backup multiple times or creating redundant backups that unnecessarily consume storage resources is not permitted.

Terms of Service

Please read these Terms of Service (“TOS”) carefully before purchasing or using any services provided by the Company. By purchasing, accessing, or using our services, you agree to be bound by these TOS. If you do not agree with any part of these terms, you should not proceed.

Account Eligibility

Transfers

Domain or service transfers must comply with policies. Users remain responsible for fees and may experience delays if violations exist.

Content

Users retain ownership of uploaded data but grant the Company a license to host and process data for service delivery. Illegal content is prohibited.

Compliance with Applicable Law

Users must comply with local, national, and international laws. Unauthorized or illegal use may result in account suspension, reporting, or legal action.

Third Party Products and Services

Third-party providers, resellers, and websites may be used; their terms apply. The Company is not responsible for external content.

Prohibited Persons

Services are unavailable to sanctioned individuals or entities. Violations may result in termination and reporting.

Account Security

Users are responsible for securing login credentials. Unauthorized access is at the user’s risk, and suspicious activity must be reported promptly.

HIPAA Disclaimer

The Company is not HIPAA-compliant. Do not provide Protected Health Information (PHI) through our services.

Compatibility with Services

Users must ensure devices, software, and internet meet requirements. The Company is not responsible for compatibility issues or related costs.

Billing and Payment Information

Fees must be prepaid; subscriptions auto-renew unless canceled. Users are responsible for taxes, late payments, domain fees, fraud prevention, and billing disputes.

Resource Usage

Use resources lawfully and within plan limits. Excessive use may result in suspension or account adjustment.

Uptime Guarantee

We aim for 99.9% uptime but do not guarantee uninterrupted service. Service credits may apply per SLA.

Store

Products are subject to availability, pricing changes, and accuracy. Purchases are subject to TOS, Privacy Policy, and refund policies.

WordPress Plugins

We do not guarantee third-party plugin functionality. Users are responsible for reviewing licensing, privacy, and performance impacts.

Coupons

Promotional codes are subject to terms, have no cash value, and may be modified or canceled without notice.

Limitation of Liability

The Company and affiliates are not liable for indirect or consequential damages. Total liability is limited to amounts paid in the last 12 months.

Indemnification

Users agree to indemnify the Company against claims arising from their use of services, violations of TOS, or applicable laws.

Arbitration

Disputes are resolved via binding arbitration, except for injunctive relief. Jury trials and class actions are waived to the fullest extent permitted by law.

Independent Contractor

Users and the Company operate independently; no partnership or employment relationship is created.

Domain Registration Agreement

This agreement outlines the terms and conditions for registering and maintaining domain names with our service. By registering a domain, you agree to comply with these terms.

1. Our Services

We provide domain registration, domain transfer, and DNS management services. Our platform allows users to manage their domains, set up email forwarding, and configure web hosting settings.

Users are responsible for keeping their account information secure and ensuring that domain registration information is accurate and up-to-date.

2. Limitation of Liability

We are not liable for any loss of data, revenue, or profits resulting from the registration or use of your domain. Our services are provided on an "as is" basis, and we disclaim all warranties.

Users acknowledge that domain registration is subject to availability and the rules of the applicable domain registry.

3. Multiple Domain Registrations

Users may register multiple domains, but each registration must comply with our terms and policies. Bulk registrations may be subject to additional review.

Failure to comply with domain usage policies may result in suspension or cancellation of multiple domains.

4. Fees

  • Payment of fees: Registration is confirmed only after full payment of the applicable fees.
  • Modification of fees: We reserve the right to adjust domain registration fees at any time.
  • Credit card chargebacks: Any chargebacks for domain or service fees may result in suspension of services.

5. Required Domain Registration Information

Users must provide accurate contact information, including name, email, and phone number. Incorrect information may lead to registration cancellation.

  • Registration information: Must include legal name, address, and email.
  • Additional registration information: May include technical contact details and administrative contacts.
  • Use of information: We may use registration data to contact you regarding your domain or comply with legal requirements.
  • Information updates: Users must update registration details promptly to maintain domain ownership.
  • Renewal requirements: Accurate information is required for timely domain renewals.
  • Ownership of data: All registration data remains the property of the registrant.
  • Registrant verification: We may request verification of your identity to prevent fraud.

6. Domain Privacy Service

Our privacy service masks your contact information in public domain records. This helps protect against spam, unwanted solicitations, and identity theft.

Users may opt-in or opt-out of privacy services at any time, but availability depends on the domain registry.

7. Domain Parking

Domains may be parked using our service, allowing display of advertising or “coming soon” pages. Parking does not transfer ownership or rights of the domain.

Revenue generated from parked domains may be shared according to the terms of our parking program.

8. Registration Renewal

Domains must be renewed before their expiration date to maintain ownership. Renewal notices will be sent via email prior to expiration.

Failure to renew may result in the domain becoming available for registration by others.

Customer Hosting Agreement

This Customer Hosting Agreement ("Agreement") sets forth the terms and conditions under which CLOUDRAIN provides web hosting services to the customer. By using the hosting services, the customer agrees to comply with all terms outlined below.

1. Scope of Hosting Services

CLOUDRAIN provides hosting services including shared hosting, virtual private servers (VPS), dedicated servers, and managed cloud hosting. The services may include storage, bandwidth, email, database access, and control panel tools as specified in the customer’s selected plan.

2. Customer Responsibilities

  • Maintain the confidentiality of account login credentials and promptly report any unauthorized access.
  • Ensure that hosted content complies with applicable laws, including copyright, privacy, and data protection regulations.
  • Use hosting services only for lawful purposes; prohibited uses include spamming, malware distribution, and hosting illegal content.
  • Backup critical data. While CLOUDRAIN performs routine backups, the customer is responsible for maintaining independent copies of important data.

3. Service Availability & SLA

CLOUDRAIN guarantees 99.9% uptime for hosting services, excluding scheduled maintenance. Customers will be notified in advance of planned maintenance. Service credits may be issued for downtime exceeding the SLA as outlined in the Service Level Agreement.

4. Data Security & Privacy

Customer data is owned by the customer. CLOUDRAIN implements security measures such as encryption, firewalls, and access controls to protect customer data. Data will only be shared with third parties as legally required or as necessary to provide the hosting services.

5. Fees and Payment

Hosting fees are billed monthly or annually based on the selected plan. Non-payment may result in suspension or termination of services. Any applicable taxes are the responsibility of the customer. Fees may be adjusted with 30 days’ notice.

6. Termination of Services

Either party may terminate this Agreement with 30 days’ notice. Upon termination, hosting services will cease, and customer data will be retained for 30 days to allow data export. After this period, data may be permanently deleted.

7. Warranties and Disclaimers

Hosting services are provided “as-is” without warranties except as described in the SLA. CLOUDRAIN does not guarantee that services will meet all customer requirements or that all data loss or downtime will be prevented.

8. Limitation of Liability

CLOUDRAIN’s liability is limited to the total amount paid by the customer for the hosting services during the three months preceding a claim. Neither party shall be liable for indirect, incidental, or consequential damages.

9. Governing Law & Dispute Resolution

This Agreement is governed by the laws of INDIA. Any disputes will first be addressed through negotiation. If unresolved, disputes may be submitted to arbitration or the courts of [Jurisdiction].

10. Support

Customer support is available via email at support@CLOUDRAIN.IN or through the online help portal. Technical issues, billing questions, and service inquiries will be addressed within 24 hours during business days.

Customer Digital Certificate Agreement

This agreement outlines the terms and conditions governing the issuance, use, and management of digital certificates provided to the customer by the certificate authority (CA).

1. Scope of Services

The certificate authority will provide the customer with digital certificates for authentication, encryption, and digital signatures. Certificates may be used for securing websites, email communications, and internal applications.

2. Customer Responsibilities

  • Ensure all certificate requests are accurate and truthful.
  • Protect private keys and credentials associated with issued certificates.
  • Use the certificates only for authorized purposes and in compliance with applicable laws.
  • Notify the CA immediately if any certificate is compromised or suspected of being compromised.

3. Issuance and Validation

The CA will validate the identity and authority of the customer before issuing a digital certificate. The issuance process may include verification of legal entity, domain ownership, or individual identity, depending on the type of certificate.

4. Certificate Renewal and Revocation

Certificates must be renewed before expiration to maintain validity. Customers may request revocation of a certificate if it is no longer needed or if private key compromise occurs. The CA will revoke the certificate promptly and update certificate status information accordingly.

5. Security and Liability

The CA implements security measures to protect the integrity of certificates and associated private keys. However, the customer is responsible for secure storage of private keys and proper usage. The CA’s liability for damages is limited to the fees paid for the certificate during the current term.

6. Fees and Payment

Customers agree to pay all fees associated with certificate issuance, renewal, and related services. Failure to pay may result in suspension or revocation of certificates.

7. Termination

Either party may terminate this agreement with prior notice. Upon termination, the customer must stop using all certificates issued under this agreement and ensure proper disposal of private keys.

8. Governing Law

This agreement shall be governed by and interpreted in accordance with the laws of the jurisdiction in which the certificate authority is registered.

9. Contact Information

For support, inquiries, or reporting certificate issues, the customer may contact the certificate authority through email, support portal, or phone as provided on the official website.

Customer Domain Registration Agreement

This Domain Registration Agreement ("Agreement") outlines the terms and conditions under which CLOUDRAIN provides domain name registration services to the customer. By registering a domain, the customer agrees to comply with these terms.

1. Domain Registration Services

CLOUDRAIN provides domain name registration, renewal, transfer, and management services for top-level domains (TLDs) and country-code domains (ccTLDs). The customer acknowledges that registration is subject to the rules and regulations of the relevant domain registry.

2. Customer Responsibilities

  • Provide accurate, complete, and current contact information for the domain registration.
  • Maintain control of account credentials and promptly notify CLOUDRAIN of any unauthorized access.
  • Use the domain name in compliance with applicable laws and avoid illegal activities such as cybersquatting, fraud, or trademark infringement.
  • Renew domain registration before expiration to avoid loss of the domain.

3. Domain Ownership

The domain registration is maintained on behalf of the customer; however, the ultimate ownership is governed by the registry rules. The customer holds all rights to the domain name while the registration is active and in compliance with this Agreement.

4. Fees and Payment

Registration and renewal fees are due in advance. Non-payment may result in suspension, cancellation, or loss of the domain. Fees are non-refundable except where required by law.

5. Domain Transfers

Domain transfers to another registrar are permitted in accordance with ICANN and registry rules. The customer is responsible for ensuring eligibility and compliance with transfer requirements.

6. Termination

Either party may terminate this Agreement by discontinuing use of the domain. Upon termination or non-renewal, the domain may be released for registration by others following the registry's expiration and redemption periods.

7. Warranties and Disclaimers

CLOUDRAIN does not guarantee that a domain will be available for registration, nor that it will remain secure or free from interruption. Services are provided “as-is” without warranties beyond what is described by the domain registry.

8. Limitation of Liability

CLOUDRAIN’s liability is limited to the amount paid by the customer for the domain registration during the current registration period. Neither party shall be liable for indirect or consequential damages.

9. Governing Law & Dispute Resolution

This Agreement is governed by the laws of [Your State/Country]. Disputes will first be addressed through negotiation. If unresolved, disputes may be submitted to arbitration or courts of [Jurisdiction].

10. Support

Customer support is available via email at support@[yourcompany].com or through the online help portal. Support includes registration, renewal, transfer inquiries, and troubleshooting domain-related issues.

Customer Web Services Agreement

This agreement sets forth the terms and conditions under which customers may access and use the web services provided by CLOUDRAIN. By using the services, the customer agrees to comply with all terms outlined below.

1. Scope of Services

CLOUDRAIN provides web services including cloud hosting, web application deployment, API access, and data analytics tools. The customer may access and use these services according to the subscription plan selected.

2. Customer Responsibilities

  • Provide accurate account information and maintain the confidentiality of login credentials.
  • Use the services only for lawful purposes and in accordance with the subscription plan.
  • Ensure that uploaded content complies with copyright, privacy, and data protection laws.
  • Promptly notify CLOUDRAIN of any unauthorized access or suspected security breaches.

3. Service Availability & SLA

CLOUDRAIN guarantees 99.9% uptime for hosted services, excluding scheduled maintenance. Customers will be notified in advance of planned downtime. In case of prolonged outages, service credits may be issued as outlined in the Service Level Agreement.

4. Data Ownership & Security

All customer data remains the property of the customer. CLOUDRAIN implements industry-standard security measures including encryption, access controls, and regular backups to protect customer data. Data will not be shared with third parties except as required by law.

5. Fees and Payment

Customers are responsible for all fees associated with their subscription plan. Billing is monthly unless otherwise specified. Non-payment may result in service suspension. Any applicable taxes are the responsibility of the customer.

6. Termination

Either party may terminate this agreement with 30 days’ notice. Upon termination, access to services will cease, and customer data may be deleted after 60 days unless the customer requests data export. Refunds will be handled per the subscription terms.

7. Warranties and Disclaimers

Services are provided “as-is” without warranty of uninterrupted access, except as described in the SLA. CLOUDRAIN does not guarantee that the services will meet all customer requirements or that data loss will not occur.

8. Limitation of Liability

CLOUDRAIN’s total liability under this agreement is limited to the amount paid by the customer in the three months preceding the claim. Neither party is liable for indirect, incidental, or consequential damages.

9. Governing Law & Dispute Resolution

This agreement is governed by the laws of [Your State/Country]. Disputes will first be addressed through informal negotiation. If unresolved, disputes may be brought to arbitration or the courts of [Jurisdiction].
